Cosmos Group SP z.o.o. a Poland based fresh apple packer & shipper cheated GSPC Europe BV company based in the Netherland to the tune of EURO 55,000 .
The Netherlands-based company placed an order for 12 containers of fresh Gala apples and paid in advance for all of them. After a delay of 45 to 60 days, they dispatched the first shipment, followed by the second and third shipments. Consequently, we requested a refund for the advance payment on the remaining 9 containers. Meanwhile, the first container arrived at Chennai port. Upon clearing the cargo, we discovered that over 50% of the apples had significant quality issues, including rot, shrinkage, and mechanical damage. In response to our claim, the company denied responsibility, despite their branded cartons being present and a third-party survey, complete with photos and videos, having been conducted. The survey report was submitted to them. They then threatened us to pay the full value of the second and third containers, which were still in transit. Under this pressure, we were compelled to pay the full amount after adjusting for the advance on the 9 containers. Before making the full payment, they withheld the shipping documents necessary to verify the shipment. After numerous requests, they provided only a copy of the phytosanitary certificate and the certificate of origin. No Bill of Lading was provided to check the shipment status. Upon arrival, the second container exhibited similar quality issues, affecting approximately 40% of the apples. The third shipment also had similar issues, with approximately 55% of the apples affected. We engaged a more reputable third-party survey company, and their reports were submitted to the supplier. Nevertheless, the packer, COSMOS, continues to deny that these are their apples, which seems to be a tactic to avoid addressing the claims. Photographs have been taken to demonstrate the quality issues using their own brand and containers.
Such dishonest operators should not be allowed to continue in this industry, and we urge the local Polish government to intervene. This is not only a matter of concern for Poland but also affects the reputation of the EU in the global fresh produce industry.
